We offer comprehensive legal support, both in the process of obtaining a license from the Polish Financial Supervision Authority for the provision of payment services (as a national or small payment institution) and in connection with ongoing business. We represent clients in audit procedures and assist them in implementing audit recommendations and advise national payment institutions (KIP), payment service bureaus (BUP), and entities preparing to become small payment institutions (MIP).
We draft and develop all necessary procedures, framework agreements and regulations related to the licensing process, registration and passporting, and the provision of payment services. We also support entities intending to act as Third Party Provider (TTP) in preparing the necessary documentation and implementing appropriate procedures, and represent them before the Polish Financial Supervision Authority. We assist clients in conducting business involving activities based on exclusions relating to services based on payment instruments that can only be used in a limited network. We prepare opinions and memoranda explaining regulatory concerns.
