A case against Ringier Axel Springer Polska won before the Supreme Court
The dispute concerned a press article that mentioned the criminal past of a former acting manager of the Centre for Education Development (a public entity of the Ministry of National Education), who was responsible for the use of EU funding. As a result of the cassation appeal filed by K&P’s lawyers, the Supreme Court held that expungement of conviction was a legal fiction that did not erase the conviction from people’s minds and did not change the facts. A conviction, even if spent, can be significant and may be mentioned in the press, especially in relation to public officers. The judgment is final.
A case won for the Publisher of Przegląd Sportowy magazine and football player Tomasz Frankowski against Frankowski’s manager
The dispute concerned a press article which described the unethical and dishonest behavior of the sport manager towards Tomasz Frankowski when the player was being transferred from Elche CF to Wolverhampton Wolves. The manager sued the publisher of Przegląd Sportowy, the authors of the article and the player, demanding an apology and damages of PLN 760,000. As a result of representation by K&P, the case has been won in its entirety in appellate proceedings, and the Supreme Court has refused to hear the claimant’s cassation appeal due to lack of grounds. The judgment is final.
A case won for the Editor in Chief of Newsweek Polska against Marek Falenta
Marek Falenta, a businessman who was a defendant in the so-called phone hacking scandal, demanded that the Editor in Chief of Newsweek Polska publish a correction to the article titled “Po nitce do Falenty”. As a result of the appeal filed by K&P’s lawyers, the Court of Appeal changed the judgment of the Court of first instance and dismissed the action in its entirety. The judgment is final.
