ESG

Sustainable development is becoming increasingly important in business. For a company, the process of linking its corporate image to sustainable practices whilst managing sustainability risks is an important element of its business organisation, which may affect the assessment of its credibility and competitiveness, the obtaining of financing or its attractiveness on the labour market. Sharing information on environmental, social and governance (ESG) factors is increasingly becoming a requirement for businesses seeking financing and is driven by the expectations of the financial sector, which values sustainability as a key priority.

Kochański & Partners offers support to companies that are committed to business transparency and proper ESG reporting. We have extensive experience in developing and implementing appropriate mechanisms and procedures concerning all aspects of ESG, whether relating to sustainability and environmental protection (E), employment and creating a comfortable, safe working environment (S), or compliance of business activities with all laws and regulations, including corporate governance (G).

We have significant experience in assessing business operations towards the transition to a low-carbon economy and reduction of carbon footprint as a key ESG aspect.

ESG Reporting

Currently, the ESG reporting obligation applies to large public-interest entities. In accordance with the proposal for a Corporate Sustainability Reporting Directive (CSRD), this obligation will be extended to other entities, to ultimately cover all large businesses (i.e. companies with more than 250 employees and meeting certain financial criteria regarding the balance sheet total or net turnover) and companies listed on a regulated market (except listed micro-enterprises).

We offer support at all stages of ESG reporting. We also have experience in supporting clients in developing ESG strategies that set corporate sustainability goals.

Environmental factors

Environmental regulations are becoming an important part of corporate strategy, particularly corporate risk management. In addition to financial penalties, penalties for non-compliance increasingly include personal (criminal) liability of company executives, which cannot be insured against. In addition, environmental regulations are becoming the foundation for improving competitive advantage in the industry and building a socially responsible and environmentally-friendly image. Our team of seasoned environmental experts supports clients in environmental compliance, development of environmental strategies, green trends and green financing.

Social factors

Our experts help develop and implement appropriate mechanisms and procedures for hiring new personnel and creating a comfortable and safe working environment. We support businesses in meeting their obligations in counteracting mobbing, discrimination and corruption and reporting other violations.

Governance factors

We provide comprehensive legal services enabling our clients to ensure compliance with all legal regulations, including corporate governance, taking into account their business needs and environment. We keep abreast of legislative developments and their potential impact on clients’ business. We also have experience in working towards socially responsible corporate governance, and support the development of an internal corporate culture of integrity playing an important role in the ESG rating process.
