Energy Law – New Deadlines in the Era of COVID-19

Due to the state of epidemic, Shield 2.0* has extended the deadlines for entities operating in the energy sector. The new deadlines are presented below:

New deadline

The validity of licensing decisions that expire during the state of epidemic threat or state of epidemic in the territory of the Republic of Poland has been extended, provided that an energy undertaking applies for the license period to be extended no later than 30 days prior to its expiry.

The period of appointment of a distribution system operator and natural gas liquefaction system operator (expiring before 31 December 2020), by decision of the President of the Energy Regulatory Office, has been extended.

The period of validity of qualification certificates for individuals maintaining electricity, heating and gas networks, appliances and installations (expiring between 1 March 2020 and 30 December 2020) has been extended.

The period of appointment of qualification boards issuing qualification certificates for individuals maintaining electricity, heating and gas networks, appliances and installations (expiring between 1 March 2020 and 30 December 2020) has been extended (regular period is 5 years).

Deadline for notifying the minister competent for energy and the President of the Energy Regulatory Office of the actual mandatory natural gas stocks maintained and their storage location (information as at 1 October 2020)

Deadline for notifying the minister competent for energy and the President of the Energy Regulatory Office of actions taken between 1 January and 31 December of the previous year to ensure state fuel security in the scope of trade in natural gas with foreign states or import of natural gas and fulfilment of the obligation to maintain mandatory natural gas stocks
