When dealing with serious conflicts and disputes, rather than escalating, mediation allows for a win-win solution or, at least, for a better understanding of parties’ positions, expectations and concerns.
Mediation is something lawyers should definitely use more often, as it can help clients to more smoothly achieve their business goals by resolving conflicts swiftly and efficiently. Depending on the mediator’s skills, this can be a process in which all stakeholders contribute in a civilized and systematic manner.
Polish businesses refer to mediation more often than in the past, and especially since the Polish legal system provides for the courts’ duty to promote mediation and extra-judicial methods of dispute resolution. However, there are still many myths and misunderstandings which should be cleared up.
And because all doubts should be addressed at its source, on 20 March we invite you to a meeting on the role of mediation in the business world. Our special guest at the event will be professor Eugene B. Kogan, a lecturer within Harvard Division of Continuing Education’s Professional & Executive Development Program, and co-author of the book “Mediation: Negotiation by Other Moves”.
The meeting will be hosted by Marek Jeżewski, head of our dispute resolution and ADR practice and co-editor of the Polish translation of the book and Michał König, head of commercial disputes at Kochański & Partners.
