Where there is a hot topic, there is also a tax challenge. So what do we already know about this? And where does Poland fit into the puzzle?

Autumn 2022 has brought a strong cooling in the crypto market, which however remains a huge and very lucrative piece of cake. It is worth mentioning that as recently as November 2021, the cryptocurrency market had reached its highest ever levels, valued at almost USD 3 trillion.

No doubt this has already come to the attention of lawmakers, who are looking for ways to tax crypto market transactions. After all, as Benjamin Franklin wrote, “in this world nothing can be said to be certain, except death and taxes”.

What is Poland’s idea of taxing crypto assets

At the moment, we are in an impasse. Polish regulations on the taxation of cryptocurrencies, NFTs, Metaverse and the existing practices of the tax authorities are mediocre, to say the least, compared to the rest of the world.

However, the situation cannot last, and so the question is what will the Polish lawmakers do in the near future? Will they, following the example of Germany, Estonia and Malta, simplify regulations in order to keep domestic cryptocurrency and NFT investors at home while encouraging foreign investors to enter the Polish market?

Or, instead, will they tighten regulations – or even do nothing at all, thus leaving uncertainties which may translate into long and costly tax disputes in administrative courts.
