However satisfying the award from the ITR EMEA Tax Awards 2025 is, it is just another stage in this exciting professional adventure.

We have won the ITR EMEA Tax Awards 2025 Poland Tax Litigation Law Firm of the Year

The prestigious ITR EMEA Tax Awards statuette is not only a recognition for our tax team, but above all further proof of the effectiveness of our philosophy of ‘Litigation by Sectors: Kochański & Partners Perspective’.

Businesses in Poland have always had to operate in an exceptionally challenging tax environment. Rapidly changing regulations, late clarifications, short vacatio legis, and high penalties for even minor infringements make cases increasingly complex, procedures longer and the outcomes of litigation with the tax authorities unpredictable.

This is why companies need genuine partners to support them. Partners who not only have an excellent knowledge of the law, keep abreast of and actively comment on changes, but are also able to think strategically and outside the box, while fighting relentlessly for their clients’ interests.

Tax litigation that changes the rules of the game

Agata Dziwisz-Moshe and her team understand that tax litigation involves more than just tax proceedings.

Complex tax matters require a multifaceted approach that skilfully combines solid substantive knowledge of many areas — not just tax law — with strategic thinking and consistent execution.

We specialise in handling precedent-setting cases, including for global financial institutions, and in tackling challenges that go far beyond the standard interpretation of regulations, covering both national and EU law.

Our work involves operating effectively at many levels, from engaging in active dialogue with the Ministry of Finance and tax authorities to representing clients in litigation in courts of every instance.

Precedent-setting successes

We have implemented projects that have led to multi-million-zloty tax refunds, including in cases relating to back-office services for financial institutions. Thanks to our non-standard approach, based on the case law of the Court of Justice of the European Union, we have successfully recovered 100% of our client’s disputed VAT. This was despite the authorities initially taking a negative position.

The key to success in such cases is determination and attention to detail. This is essential at every stage of the proceedings, from verification, audit and tax proceedings before the tax authorities, to hearings before administrative courts, such as the Provincial Administrative Court (WSA) and the Supreme Administrative Court (NSA).

Value for business

For our clients, who are global market players, victories before the Provincial Administrative Court or the Supreme Administrative Court mean more than just a substantial refund. Above all, they confirm the validity of their actions. In the long term, they also help to create a more predictable and stable operating environment. This is why we approach every case, regardless of its complexity, with the utmost attention and commitment. This enables us to achieve the best possible result every time.

This requires a mature approach to risk management and involves seeking agreement among representatives of tax administration, building arguments and negotiating solutions that protect our clients’ businesses and strengthen their competitive advantages, says the Head of our Tax Practice with conviction.

The award from the ITR EMEA Tax Awards 2025, alongside the recent ‘Poland Firm of the Year’ nomination and Piotr Kochański’s individual nomination for ‘Central & Eastern Europe Litigator of the Year’ in the prestigious Benchmark Litigation Europe Awards 2025, are strong confirmation that our approach to litigation is both effective and internationally recognised.

We have proven time and again that we are not afraid of precedents; in fact, we specialise in them. We are renowned for our ability to transform complex challenges into strategic victories.

Recognition in the transfer pricing category

In addition to winning gold in tax litigation, we are also shortlisted for Transfer Pricing Law Firm of the Year. Being nominated in such a competitive category is a strong testament to our team and its work, and means that we are ranked among the very best in Poland.

This is because we have many years of experience in the area of transfer pricing and can offer our clients comprehensive support in this field. We understand perfectly how important it is to ensure tax compliance and minimise the risk of settlements being challenged by the tax authorities. We specialise in strategic transfer pricing risk management, supporting companies in the safe and effective execution of intra-group transactions. Our approach combines operational efficiency with full regulatory compliance, protecting our clients from potential disputes with the tax authorities.

Our philosophy: Litigation as a strategic challenge

At Kochański & Partners, we believe that litigation is a complex strategic challenge that requires excellent industry knowledge and an understanding of a particular business, as well as the courage to take on precedent-setting cases. This combination enables us to develop bold, unconventional and, above all, effective arguments.

These nominations and awards are a welcome recognition of our work, but more importantly, they are a very tangible confirmation that we are on the right path. What’s more, this approach is valued by the market. This award is not for a single project, but for our consistent vision and the hundreds of battles we have won alongside our clients. We believe that a modern litigation practice is a strategic centre where in-depth knowledge of sectors is combined with innovative argumentation. And it is precisely this model, which we have been developing gradually and consistently, that has been recognised by the creators of the ITR Tax Awards and the Benchmark Litigation Awards, emphasises Piotr Kochański.

We look to the future. And we see that litigation is becoming increasingly integrated into everyday business strategy. Our role is therefore not only to respond to problems, but above all to anticipate them and turn risks into opportunities.

The award from the ITR EMEA Tax Awards 2025 and the nominations in the Benchmark Litigation ranking are wind in our sails. They motivate us to raise the bar even higher and prove that it is possible to chart a course to victory even in the most turbulent waters.

We would like to thank our clients for their trust, and the ranking committees for recognising our work in such an exceptional way.
