A new act on entrusting work to foreigners in Poland came into force on 1 June 2025. It sets out the rules under which employers may hire foreign workers, as well as the requirements that both parties must meet.
The act introduces many new solutions while adapting and streamlining previous regulations.
The new regulations define and describe issues such as:
- Conditions under which foreigners may access the Polish labour market
- Competent supervisory authorities
- Procedures for obtaining documentation to legalise the employment of foreigners
- Penalties for illegal employment
They also:
- Introduce full electronic processing of procedures
- Remove the requirement for a labour market test
- Introduce restrictions on applying for a work permit for posting purposes and regarding the basis for residence that entitles a person to work legally
Understanding the new regulations is essential for the effective management of human resources and helps to avoid the risk of decisions being issued that require foreign employees to leave the country immediately, e.g. due to their illegal stay.
