Agata Dziwisz-Moshe shortlisted for Women in Business Law Awards

Agata is a force of nature that does not hesitate to challenge the status quo. And when others say that nothing can be done, she is able to look at things from a completely different perspective. And to propose effective solutions.

She is a focused, highly qualified lawyer and an energetic and passionate manager who skilfully combines her professional strengths – strategic, multi-level planning, targeted action and rapid response.

Agata is not afraid of challenging opponents or uphill climbs. She has proven time and again that she can fight and win. Even when she is up against unfavourable tax rulings, negative case law and a strong tax authority. And that is why she has been shortlisted for the Legal Benchmarking Group’s Women in Business Law EMEA Awards in the category Lawyer of the Year – Tax.

Tax implications of politics and business

Agata has shown that she enjoys and excels in situations where it is not always easy, such as in the patriarchal, male-dominated environment of the financial industry. For example, last year she was the initiator and originator of a debate on the tax consequences of bank loan settlements at the Polish Bank Association.

Now, in the debate about the tax law consequences of settlement agreements in Swiss franc mortgage cases she is arguing strongly for financial institutions to be able to settle tax costs, and developing and implementing innovative and effective civil law arguments to back up her statements.

Agata’s efforts in this respect are based on the clear assessment that the current approach of the administrative courts to this issue leads to unjustified double taxation and thus distorts the essence of income taxes and, in the long term, the foundations of the rule of law.

By involving all stakeholders in meaningful dialogue, we have been able not only to identify problem areas, but above all to develop tangible solutions and legal arguments. The whole process proves that the exchange of experience and expertise between different experts is essential for the successful resolution of complex issues. And not just tax issues, Agata is convinced.

A modern and popular leader

As a leader, Agata firmly believes in the potential of teamwork and the power of brainstorming and insists that every initiative has meaning and significance.

All initiatives are important, relevant and deserve due attention. A joint discussion can contribute to the development of a viable substantive solution and, ultimately, to the success of a particular project and case, emphasises the Head of our Tax Practice.

She is a beloved mentor to young lawyers who, under her wing, have the opportunity to challenge themselves, mature and prepare for the next stage of their careers. She gives her colleagues the space to grow and, when they are ready, she vigilantly raises the bar.

This is why she leads such a close-knit and successful team.

Creating the future

Agata returned from maternity leave just a few months ago. Since then, she has successfully concluded several major proceedings and projects for her clients, organised a financial debate with representatives of the largest Polish banks, conducted numerous webinars and training sessions, including those aimed at preparing taxpayers for upcoming changes in tax legislation, and represented the interests of clients in numerous tax consultations.

Another project in which Agata is deeply involved is a proposal for deregulatory changes in tax law. Together with representatives of the Warsaw Enterprise Institute, Agata’s team is working flat out to promote the deregulation of Polish law and businessman Rafał Brzoska’s SprawdzaMY initiative. In this respect, they have managed to develop and communicate four substantial proposals. We are delighted that all the changes proposed by Agata’s team have already been included in the draft amendments to tax legislation proposed by the Ministry of Finance.

We are only in the first half of 2025 and Agata has not yet said the last word.
