KZR&P wins another important claim concerning the protection of personal rights before the Supreme Court

We are delighted to announce that on June 2, 2011, Rafał Zięba (Advocate and Senior Partner) and Tobiasz Szychowski (Advocate and Partner), representing Bogdan Klich, the Polish Minister of National Defence, won an important claim concerning the protection of personal rights brought against Presspublica Sp. z o.o., the publisher of “Rzeczpospolita”, one of Poland’s leading daily newspapers.
Two articles published in Rzeczpospolita on July 7, 2008, entitled “Pułkownik oskarża resort obrony” ("The Colonel Accuses The Ministry of National Defence") and "Decyzje podejmuje się z naruszeniem prawa" ("Decisions are Made in Contravention of the Law”) formed the subject-matter of the claim brought by Minister Klich. The original ruling by the Court of Appeal confirmed that there was a breach of Minister Klich’s personal rights and ordered Presspublica to officially apologize to Minister Klich in “Rzeczpospolita” (with a view to these statements also being published in “Gazeta Wyborcza”, another leading Polish daily newspaper) and to pay PLN 5,000 to charity. Although an appeal was made by Presspublica, the Supreme Court upheld the Court of Appeal’s decision, stating that the author of the article did not adhere to the obligations of reasonable diligence or integrity in journalism, thereby breaching a provision in Article 12 of the Polish Press Law.
